The Make It Beef Contest, 2009 (the “Contest”) opens February 23, 2009 and closes with a final draw on May 20, 2009 (the “Contest Period”). The deadline for submitting contest entries before the final draw is 11:59am Eastern Standard Time on May 19, 2009 (the “Entry Deadline”). The Contest is sponsored by the Beef Information Centre, a division of the Canadian Cattlemen’s Association (the “Beef Information Centre”). No purchase is necessary to enter. Entry in the Contest constitutes acceptance of the terms, conditions and provisions set out below.

1. HOW TO ENTER

1.1. Eligible individuals may enter the Contest with no purchase necessary by logging onto the website located at www.beefinfo.org before the Entry Deadline and follow the instructions to enter the Contest.

1.2. Each entry must include the entrant’s full legal name, a mailing address and a telephone number or email address together with a description of the entrant’s experience preparing and consuming an eligible beef recipe and a photograph of the prepared dish. Eligible beef recipes are those available on the web site at www.beefinfo.org.

1.3. Upon receipt of your entry, you will be automatically enrolled in the Contest. To be eligible, your entry must be received by the Beef Information Centre before the Entry Deadline.

1.4. Although individuals may enter the Contest more than once, each entry must relate to a different eligible beef recipe and include unique comments and photographs of the completed recipe.

2. PRIZES

2.1. The prizes to be awarded consist of:

A two-night stay for two people at Inn on the Twenty located in Jordan, Ontario. The stay includes two nights at the Inn, two complimentary breakfasts and dinner for two at the Inn on the Twenty Restaurant.

There are six prizes available to be won.

2.2. The retail value of each prize to be awarded is:

$771.00 CDN per couple per stay.

2.3. The odds of winning will depend on the number of qualifying entries received. The total number of prizes available to be won, and the odds of winning any particular prize, will diminish as prizes are claimed.

2.4. At 12:00 noon Eastern Standard Time on each of March 17, 2009, April 15, 2009 and May 20, 2009 in Mississauga, Ontario, a random draw will take place from all eligible entries. Two winning entries will be selected on each draw date. Odds of an entry being selected depend on the number of eligible entries received after February 23, 2009 and 24 hours before the date and time of each draw. The selected entrants will be notified by telephone or email at the option of the Beef Information Centre within 24 hours of each draw. Up to three (3) attempts will be made to contact the selected entrants within 10 days following each draw. The Beef Information Centre accepts no liability for incorrect, incomplete or illegible contact information provided to it. Return of any prize notification as undeliverable will result in disqualification of the selected entrant. If a selected entrant cannot be contacted in the manner described above, or if a selected entrant is not eligible or otherwise does not comply with the Contest Rules, their entry will be declared void and a further entry will be randomly selected.

2.5. To claim any prize, a selected entrant will be required:

(a) submit valid identification from an independent source;

(b) to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question; and

(c) to provide a signed release of liability from both the entrant and their travelling companion releasing the Beef Information Centre, its affiliates and subsidiaries, advertising and promotional agencies, any judge or judges appointed by the Beef Information Centre, and in each case their respective directors, officers, owners, employees, agents, representatives, successors and assigns, from any liability in connection with the Contest or the acceptance, possession or use of the prize; and

(d) to sign and return a certificate of eligibility to the effect that they are an eligible entrant and have complied in all respects with the Contest Rules.

Failure to comply with the foregoing requirements within 10 days following attempted notification may result in disqualification and awarding the Prize to another entrant.

2.6. If a selected entrant is ineligible, or fails to comply with the provisions described above within the prescribed time limit, the prize may be forfeited and an alternate selected entrant may be selected.

2.7. The prize winner and all guests must be legal residents of Canada and eighteen (18) years of age or older at the time the prize is awarded. The trip must be taken by May 20, 2010. All expenses except those specifically described above for such prize shall be the responsibility of the prize winner and/or the prize winners’ guests, including return transportation to and from the destination, insurance, taxes not specifically included, gratuities, expenditures of a personal nature, and any required travel documents (passports, visas) or vaccinations. Trip arrangements and reservations must be made by the winner through Beef Information Centre no later than two (2) months before the planned arrival date and is subject to room availability at the Inn on the Twenty at the time of booking. For reservations purposes, the prize winner must send a fax or copy of his or her passport, driver’s license or other government issued photo identification and those of his or her guests to:

The winner and guests must arrive and stay together. Once reservations have been made, changes will not be permitted. Winners who decide to stay alone or with fewer guests than described above for such prize will not receive monetary or other compensation for the lower total value of the prize. No compensation will be paid if the trip or parts thereof must be cancelled for reasons beyond the control of the Beef Information Centre, including without limitation weather conditions.

2.8. All prizes must be accepted as awarded. Prizes are not transferable or convertible into cash. No transfer, substitution or conversion of prizes will be allowed, except by the Beef Information Centre as described below.

2.9. Except as expressly represented or warranted herein, all prizes are provided to winners “as is” without any additional or further representation or warranty of any kind.

2.10. No interest will be paid on any cash prizes.

2.11. All taxes, fees, and surcharges on prizes are the sole responsibility of the prize winner.

2.12. The Beef Information Centre reserves the right to substitute any and all prizes for prizes of equal retail value in the event that the intended prizes become unavailable for any reason beyond the reasonable control of the Beef Information Centre.

3. ELIGIBILITY

3.1. The Contest is open only to legal residents of Canada, excluding Quebec. The Contest is void where prohibited by law. The Beef Information Centre, its agents, affiliates and sponsors do not warrant that the Contest may be entered legally in any particular jurisdiction. The Beef Information Centre reserves the right to terminate the Contest or to modify the rules as necessary for any reason or as required by applicable law.

3.2. Participants must be eighteen (18) years of age or older at the time of entry.

3.3. Employees, agents and representatives of the Beef Information Centre, their respective affiliates, subsidiaries, advertising and promotional agencies, the immediate family members of the foregoing, and those with whom any of the foregoing are domiciled, are not eligible.

4. GENERAL PROVISIONS

4.1. By submitting an entry or claiming a prize, the participant agrees to be bound by all the terms, conditions and provisions set out in these Contest Rules.

4.2. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.

4.3. All decisions of the Beef Information Centre, and any judge or judges appointed by the Beef Information Centre, with respect to any aspect of the Contest shall be final and without appeal.

4.4. The Beef Information Centre accepts no liability whatsoever arising in respect of the participation in the Contest by any individual or the awarding or use of any prize.

4.5. A maximum of one prize will be awarded for each eligible Contest entry.

4.6. A list of official Contest winners may be obtained by sending a self-addressed stamped envelope, during the one-year period commencing one month following the completion of the Contest Period to:

4.7. All entries become the sole and exclusive property of the Beef Information Centre and will not be returned. The Beef Information Centre will enjoy a non-exclusive worldwide license in copyright for all submitted entries, including photographs submitted with each entry, for the purpose of promoting the MAKE IT BEEF CONTEST and the Beef Information Centre.

4.8. Entry forms are subject to verification and any entry form that is received by the Beef Information Centre and is defaced, mutilated, illegible, forged, tampered with or altered in any way, contains printing errors, or has not been obtained through legitimate channels is automatically void.

4.9. Persons found to be tampering with or abusing any aspect of the Contest, as determined in the sole discretion of the Beef Information Centre, will be disqualified.

4.10. In the event that circumstances beyond the reasonable control of the Beef Information Centre result in the determination by the Beef Information Centre, in its sole discretion, that the fairness or integrity of the Contests has been materially compromised, the Beef Information Centre reserves the right to suspend, delay or terminate the Contest.

5. PRIVACY

5.1. By entering into the Contest, you consent to the collection, use and sharing of information about you:

(a) between the Beef Information Centre and its agents and representatives for the sole purpose of administering the Contest;

(b) to initiate, maintain and develop a relationship with you in connection with the offering of goods and services of the Beef Information Centre; and

(c) to make available to you from time to time information, promotional material and other material which may be of interest to you.

5.2. By entering into the Contest, you consent to the use and disclosure of your name and likeness, without compensation, by the Beef Information Centre for the purposes of the disclosure of the identity of prize winners and for the general promotional purposes of the Beef Information Centre in connection with the Contest.

5.3. You may withdraw your consent to our collection, use and disclosure of your personal information at any time. You can ask us not to send you marketing communications by following the opt-out instructions in each communication or you may let us know by contacting our marketing department at beefcontest@beefinfo.org.

5.4. You have a right to challenge the accuracy and completeness of your personal information and to have it amended, as appropriate. You also have a right to request access to your personal information and receive an accounting of how that information has been used and disclosed, subject to certain exceptions prescribed by law. For example, if the requested information would reveal personal information about another individual, your request for access may be limited or denied. To request access or to amend your personal information, please contact our Privacy Officer at the address below. The Beef Information Centre will respond within thirty (30) days of receipt of your written request.

5.5. The Beef Information Centre will respond to inquiries about its policies and practices relating to its handling of your personal information. Inquiries should be directed to our Privacy Officer using the contact information below. The Beef Information Centre will investigate all complaints and will respond within 30 days of receipt of a written inquiry. If the complaint is found to be justified, the Beef Information Centre will take appropriate measures to resolve it, including, if necessary, amending this Policy and its procedures.

5.6. Like most other commercial websites, the Beef Information Centre may monitor traffic patterns, site usage and related site information to optimize your visit to our website. To help save you time, we use a special feature called a “cookie” to help us provide customizable services to our customers. Cookies are like mini-files that live on your hard drive and save your preferences so you do not have to re-enter the same information over and over again. Cookies do not damage your system or impair its functioning in any way. You can choose whether to accept cookies by changing the settings of your browser. If you choose not to accept cookies, your experience on this web site may be diminished and some features may not work as intended.

5.7. While we welcome email inquiries, email sent over the Internet is not secure and may be lost, intercepted, or altered. If you send personally identifiable information to us via email, we will not be liable if it is lost or intercepted, altered or misused by someone else.

5.8. If you have any questions or complaints about the handling of your personal information, if you wish to withdraw your consent to our use of your personal information, or to request access to or update any information we have on file, please contact:

6. LIMITATION ON LIABILITY

6.1. The Beef Information Centre, its affiliates and subsidiaries, advertising and promotional agencies, any judge or judges appointed by the Beef Information Centre, and in each case their respective directors, officers, owners, employees, agents, representatives, successors and assigns, shall not, in any circumstances whatsoever, be liable for:

(a) any cost, liability, expense, injury, damage or claim of any kind, arising in connection with the Contest or resulting from acceptance, possession or use of any prize including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or

(b) any incidental, consequential, special or indirect damages, even if they have been advised of the possibility of such damages.

6.2. The Beef Information Centre will not be liable for late, lost, invalid, ineligible, illegible, incomplete, stolen, misdirected or postage due entries or prize claims.

6.3. The Beef Information Centre, assumes no responsibility for any problems or technical malfunction of any telephone network, telephone lines, computer online systems, servers, access providers, computer equipment, software, or the failure of any entry or prize claim to be received by the Beef Information Centre on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof.

7. RELEASE

7.1. By entering into the Contest, each participant releases and holds harmless the Beef Information Centre, its affiliates and subsidiaries, advertising and promotional agencies, any judge or judges appointed by the Beef Information Centre, and in each case their respective directors, officers, owners, employees, agents, representatives, successors and assigns, from any and all liability in connection with the Contest or resulting from acceptance, possession or use of any prize including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
